Scott S. Liberman has had a lifelong interest in medicine. Though he switched his college career track from medical school to law school, he has continued to study medicine for more than three decades with the best doctors in the country as he works up his cases with them as retained experts in the cases that he manages.
These world-renowned professionals have given him knowledge and insight as to the specific issues in any case in which he is involved which is often superior to the defendant doctors and/or their experts he is interrogating during deposition or in trial.
That detailed understanding of how healthcare providers operate and the systems in which they operate consistently give Scott the upper hand when representing clients in medical malpractice claims against hospitals, doctors, and their related entities/insurance companies. When Scott asks a question of a healthcare provider, he already knows the answer because he has learned it from studying the medicine and multiple meetings with the experts he has retained to gain a complete understanding of not only what the standard of care would require in any given circumstance, but also how the breach of that standard of care caused the injuries complained of.
That knowledge is critical not only in litigation but also when answering questions from an injured or deceased person’s family. When a health care provider fails and/or refuses to explain to someone or their family what happened, Scott helps them understand what occurred, why it occurred, and what he intends to do in order to secure justice on their behalf.
In addition to managing the direction of LCTR, Scott is personally responsible for handling the most complex cases at the firm with the expectation that the case will be tried before a jury where he takes on the role of lead counsel – talking to the jury, examining/ cross examining witnesses, and arguing points of law before the judge.
Scott does not act alone. Unlike many other firms, the attorneys at LCTR work in unison, working in tandem to develop a strategy for each case regardless of who has primary responsibility for it. Clients benefit from having four highly experienced legal minds with diverse backgrounds investigate the care and treatment that was rendered and where that care did not meet the standard of care, gather the necessary documentation with which to quantify the nature and extent of the damages sustained, craft a prosecutorial plan, and then work toward an equitable and just resolution with the client’s best interest as their number one priority.
Scott and his colleagues formed LCTR to provide small-firm care with big-firm experience, resources, and results. After getting his start at a prestigious Broward County law firm where he rose to become the lead partner in charge of its medical malpractice division, he and his partners decided they would be in a better position to serve their clients as a small, cohesive unit which puts the client’s interest first and foremost.
Once the firm has undertaken the commitment to accept a case, Scott and his colleagues aggressively pursue it without compromise to resolution through settlement or trial. Scott sets clients’ expectations by being objective about the case’s merits and keeping them apprised of all of the legal and factual developments as they occur in real time. This is done so that any decisions which need to be made are made with full knowledge of all factors that could affect the value of the case and their chances of success at trial. Because the nature of the injuries sustained in the cases which LCTR handles are significant, Scott takes time with his clients to explain to them what they can expect during the long and arduous process which is an inherent part of litigation. He has learned that keeping his clients informed alleviates much of the anxiety they typically experience when engaging in litigation and allows for thoughtful decision making when tough decisions need to be made.
After graduating from the University of Florida Levin College of Law in 1989, Scott practiced in insurance defense, from which he gained insights into legal strategies employed by those responding to a lawsuit. Shortly thereafter, he married his pre-med background to his law practice, concentrating exclusively on medical malpractice and complex litigation issues.
For close to 30 years, Scott has garnered hundreds of millions of dollars in settlements and verdicts for his clients and has litigated cases in Florida, Arkansas, Colorado, the District of Columbia, and Georgia.
Scott is AV Preeminent Peer Rated by Martindale Hubbell and has been recognized as one of the “Top 100 Lawyers” by Florida Super Lawyers Magazine as well as listed in the publication since 2010. He is also consistently named to the Best Lawyers in America’s prestigious list and in June of 2021, he was honored as the ABOTA Trial Lawyer of the Year Award which was designed to recognize his trial skills, civility and integrity.
As the attorney of the year, Scott has shown an exceptional commitment to the ideals of ABOTA and has dedicated his career to the pursuit of justice for victims of medical malpractice. During 2021-2022, a time period in which there was not always the certainty of a jury trial because of the pandemic, in three specific matters, Scott and his team were successful in recovering in excess of $60,000,000.00 for his clients who were victims of medical malpractice. Despite the magnitude of these recoveries, Scott and his team understand that the nature and extent of the injuries sustained cannot be reversed but with their help, the victims and their families will be able to obtain life-prolonging and life-altering medical care that they need which they would have otherwise been deprived of.
